Federal Judge Orders Freedom of Abrego Garcia from ICE Detention

A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.

The situation stems from a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to face human smuggling allegations, he was detained in immigration detention.

In her order, the court pointed out that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Context of the Case

The legal proceedings involve disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.

He has also pleaded not guilty to the smuggling counts, which are part of a separate criminal case in the state of Tennessee.

The court, who was hearing his petition to removal in a federal court, ruled that he must now adhere to the conditions of his release from custody in Tennessee. This decision shifts his supervision to the Tennessee court.
